Article 2. Scope of Application
These General Terms and Conditions of Sale apply to purchases made through the website moodsatelier.com.
By placing an order, the customer accepts these terms and conditions, without prejudice to the mandatory rights granted to consumers under applicable legislation.
Article 3. Artworks Offered
Moods Atelier offers original, handmade artworks.
Each artwork is presented with its essential characteristics, including its title, dimensions, materials and price.
Photographs are intended to represent the artworks as accurately as possible. Slight colour differences may occur depending on screen settings and lighting conditions.
Variations in texture, relief and materials are inherent characteristics of handmade artistic creations. Such variations do not, in themselves, constitute a lack of conformity.
The artworks currently offered are already completed and available for purchase. Personalised commissions and custom-made artworks are not yet offered directly through the online store. Their specific terms will be communicated before this service becomes available.
Article 4. Prices and Payment
All prices are displayed in euros (€).
Moods Atelier benefits from the Belgian VAT exemption scheme applicable to small businesses. No VAT is charged.
Any applicable shipping costs are indicated before the order is confirmed.
Payment is made using the payment methods available at checkout.
Order confirmation is sent by email. In the exceptional event that an artwork is unavailable because it has already been sold, Moods Atelier will contact the customer and refund any amounts paid.
Article 5. Availability of Artworks
Original artworks are generally available as one-of-a-kind pieces.
Once an artwork has been sold, an identical copy cannot be ordered.
In the event of an inventory error or simultaneous sale, Moods Atelier will inform the customer as soon as possible and issue a full refund for any order that cannot be fulfilled.
Article 6. Shipping and Delivery
Moods Atelier currently offers delivery to the following countries:
-
Belgium
-
France
-
The Netherlands
Standard shipping costs €7 per order.
Free shipping is available on orders of €300 or more.
The usual order preparation time is estimated at 2 to 4 business days. Transit times depend on the destination and carrier. The applicable delivery timeframe is communicated to the customer in accordance with legal requirements.
Artworks are carefully packaged to protect them during transportation.
For sales to consumers, the risk of loss or damage generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the artwork.
If a parcel arrives damaged, is lost or is not received, the customer is encouraged to contact Moods Atelier at hello@moodsatelier.com as soon as possible. This request for prompt contact does not limit any statutory consumer rights.
Article 7. Right of Withdrawal
In accordance with applicable distance-selling legislation, consumers generally have 14 calendar days, starting from the day after receiving the artwork, to exercise their right of withdrawal without providing a reason.
To exercise this right, the customer must clearly communicate their decision to:
The customer then has 14 days to return the artwork after communicating their decision to withdraw.
The direct costs of returning the artwork are borne by the customer when exercising the right of withdrawal, provided the customer has been properly informed of these costs before placing the order.
The customer must handle the artwork with care. The customer may be held responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the item.
Moods Atelier will refund all amounts legally due, including the original standard delivery costs where reimbursement is required, within a maximum of 14 days from receiving the withdrawal notification.
The refund may be withheld until the artwork has been received or until proof of its return shipment has been provided, whichever occurs first.
Refunds will be made using the original payment method unless expressly agreed otherwise.
Further details are provided in our Refund Policy.
Article 8. Personalised and Custom-Made Artworks
Moods Atelier may offer personalised creations and custom-made artworks in the future.
When this service becomes available, the terms relating to orders, artistic approval, pricing, payment and production times will be communicated before the contract is concluded.
Goods genuinely made to the consumer's specifications or clearly personalised may be excluded from the statutory right of withdrawal, subject to the conditions established by law.
This exception does not automatically apply to an artwork simply because it is original, unique or handmade.
Article 9. Legal Guarantee and Complaints
All artworks sold benefit from the applicable statutory guarantees, including the legal guarantee of conformity for consumer sales.
In the event of a lack of conformity, the customer may contact Moods Atelier at hello@moodsatelier.com, describing the issue and, where possible, providing photographs.
All rights and remedies provided by law remain fully applicable. Nothing in these terms and conditions is intended to exclude or restrict those rights.
Article 10. Copyright and Intellectual Property
All original artworks, artistic compositions, photographs, texts and creations displayed on the Moods Atelier website remain protected by applicable intellectual property rights.
Purchasing an original artwork transfers ownership of the physical artwork to the buyer but does not automatically transfer copyright.
Any reproduction, adaptation, commercial exploitation or distribution requiring authorisation must receive the prior consent of the copyright holder, except where permitted by law.
Moods Atelier retains the right to display photographs of its creations in its portfolio, on its website and in its communication materials, subject to third-party rights and any specific agreements made with customers.

Its liability is determined in accordance with applicable legislation.

Article 14. Applicable Law
These General Terms and Conditions of Sale are governed by Belgian law.
Where the customer is a consumer residing in another Member State of the European Union, this choice of law does not deprive the consumer of the mandatory protections provided by the legislation applicable in their country of residence.
Any disputes shall fall within the jurisdiction of the competent courts in accordance with applicable legal rules, including those protecting consumers.
Article 15. Amendments to the Terms and Conditions
Moods Atelier may amend these General Terms and Conditions of Sale for future orders.
The terms and conditions applicable to an order are those in force at the time the contract is concluded, unless otherwise required by law or validly agreed between the parties.
